Repatriation procedures for overseas Vietnamese

Currently, the overseas Vietnamese community is about 5.3 million people, distributed in more than 130 countries and territories around the world.

Overseas Vietnamese have been an integral part of the Vietnamese ethnic community. With the national spirit towards the origin of the motherland, the repatriation procedure will help overseas Vietnamese have conditions to live, work and retire permanently in Vietnam.

1. What is repatriation?

Repatriation is the fact that Vietnamese nationals who are residing abroad now want to return to live and work permanently in Vietnam.

The repatriation procedure allows overseas Vietnamese to simultaneously acquire Vietnamese citizenship and retain their current foreign nationality. Thus, overseas Vietnamese after carrying out repatriation procedures will have dual citizenship, enjoy all privileges and benefits in economic, political and social welfare of both countries of which they are nationals. Therefore, the repatriation procedure is also known as the dual citizenship registration procedure

2. Conditions for overseas Vietnamese to apply for repatriation in 2023

Viet Kieu are repatriated when the following 2 conditions are satisfied:

First: overseas Vietnamese have documents proving that they used to have Vietnamese nationality and still hold Vietnamese nationality in accordance with Vietnamese law.

Monday: Overseas Vietnamese who have legal residence in Vietnam include houses owned by themselves or houses rented, borrowed or housed by other people or guaranteed by relatives.

3. Order of repatriation application procedures

To repatriate, overseas Vietnamese must carry out procedures including 04 steps as follows:

Step 1: Prepare the repatriation dossier according to the instructions in Section 5 below.

Step 2: After preparing all documents in step 1, overseas Vietnamese submit the dossier at the Immigration Department of the police of the province or centrally-run city where the Viet Kieu has legal residence or the Immigration Department – Ministry of Public Security.

Step 3: After receiving a complete set of valid dossiers from overseas Vietnamese, the immigration authorities shall consider and evaluate the conditions, and when the dossiers meet the prescribed conditions, issue a written consent to allow overseas Vietnamese to repatriate.

Step 4: After the results of step 3, overseas Vietnamese carry out procedures such as: permanent residence registration at the police of the commune/ward/town, application for citizen identity card and Vietnamese passport.

4. What does a dossier of repatriation include?

To carry out the repatriation application procedure, you need to prepare 02 sets of documents including the following documents:

1./ Application for permanent residence in Vietnam.

2./ Foreign passport or permanent residence document issued by a foreign competent authority to Viet Kieu

3./ One of the valuable documents proving Vietnamese nationality.

4./ Copy of documents proving legal residence in Vietnam:

– In case Viet Kieu has owned a house in Vietnam, it is necessary to provide documents such as: Certificate of home ownership or documents on buying, selling, donating, giving, exchanging and receiving housing inheritance, housing purchase contract...

– In case Viet Kieu rents, borrows, stays in someone else's house or is guaranteed by relatives, it is necessary to provide documents such as: Contract for rent, loan, accommodation ...

5. How long does it take to process a repatriation application?

According to regulations, the time for processing repatriation dossiers at the Immigration Department of the provincial, municipal police or the Immigration Department – Ministry of Public Security is 40 days from the date of receipt of complete and valid dossiers.

However, the actual processing process may take a long time depending on the process of checking and verifying information related to the identity, immigration status, living history of overseas Vietnamese and in Vietnam.

Especially, with cases where Viet Kieu has permanently settled abroad, the inspection, verification and collection of information will become more difficult, more complicated, and the settlement time will also be longer.
