Marriage registration certificates are likely to be damaged, torn or lost for a long time. So in case the marriage registration certificate needs to be re-issued, what are the procedures to apply for re-issuance in Vietnam?

1. Is it possible to re-issue marriage certificates in Vietnam?

Case 1: Reissuance of original extract of marriage certificate in Vietnam

Pursuant to Article 24 of Decree 123/2015/ND-CP, the conditions for re-registration of marriage are as follows:

  • Any marriage registration that has been granted at the competent authority of Vietnam before January 1, 2016 but the vital records or original copies from vital records are lost shall be eligible for re-registration.
  • An applicant for marriage re-registration shall submit sufficient copies of relevant documents.
  • The marriage re-registration is only granted if the applicants are still alive at the time of receiving application.

As stated above, to reissue the original extract, the conditions for re-registration of marriage must be met. At that time, people in Vietnam will be considered as remarried and granted the original marriage certificate extracted from the civil registry.

Case 2: Reissuance of a copy of the marriage certificate extract in Vietnam from the civil status register

Clause 1, Article 62 of the Civil Status Law 2014 stipulates that When making civil status registration, the civil status registration agency shall grant 1 original civil status extract to the civil status registration requester, except the registration of birth and marriage in Vietnam.

According to Clause 9, Article 4 of the Civil Status Law 2014 provides for civil status extracts as follows:

Civil status extract means a document issued by a competent state agency proving a civil status event of an individual already registered at a civil status registration agency in Vietnam.

The original civil status extract shall be issued immediately after a civil status event is registered.

Copies of a civil status extract include:

  • Copies of civil status extracts issued from the civil status database
  • Certified copies of original civil status extracts.

Currently, Article 18 of the Civil Status Law 2014 stipulates that the justice and civil status officer shall report to the chairperson of the commune-level People's Committee to organize the handover of the marriage certificate to the couple in Vietnam.

Clause 2 Article 3 of Decree 23/2015/ND-CP stipulates that Copies certified as true from originals under this Decree have legal value when being used as substitutes for originals in transactions except otherwise prescribed by the law.

Thus, in addition to the case of re-registration of marriage, other cases may only provide the original exact 01 time for both men and women in Vietnam. Therefore, an applicant for a marriage certificate can only receive a copy of the civil status extract in Vietnam.

2. Procedures for re-issuing marriage certificates in Vietnam

2.1 Procedures for re-registration of marriage

Pursuant to Article 27 of Decree 123/2015/ND-CP regulating procedures for re-registration of marriage in Vietnam as follows:

Step 1: Filing

An application for marriage re-registration shall include:

  • An application form as prescribed;
  • A copy of the former marriage license.

In case of absence from the copy of marriage license, a copy of the personal document relating to the marriage registration contents is also permitted in Vietnam.

Step 2: Verify records in Vietnam and return results

Within 5 working days from the date on which the application is received, the civil status official shall verify it.

  • If the marriage re-registration is sufficient, accurate, and consistent with regulations of law, the civil status official shall grant the marriage re-registration as prescribed in Clause 2 Article 18 of the Law on civil status.
  • If the application for marriage re-registration is submitted at the People’s Committee of a commune other than the commune which has granted the former marriage registration, the civil status official shall request the President of People’s Committee to request such the People’s Committee to verify the respective vital records.

Within 5 working days, from the date on which the request is received, the People’s Committee which has granted the former marriage registration shall verify and respond in writing that whether the vital records are kept or not.

Within 3 working days in Vietnam from the date on which verification results that the vital records are no longer kept in the commune where the marriage registration has been granted are received and the application is considered satisfactory and consistent with regulations of law, the civil status official shall grant the marriage re-registration as prescribed in Clause 2 of this Article.

(The marriage relationship shall be recognized from the date on which the former marriage registration was granted which is specified in the marriage license and vital records in Vietnam. If the day and month of former marriage registration is not identified, the marriage relationship shall be recognized from January 1, of the year of former marriage registration.)

2.2 Procedures for re-issuing marriage certificates

Clause 2 Article 3 of Decree 23/2015/ND-CP stipulates that Copies certified as true from originals under this Decree have legal value when being used as substitutes for originals in transactions except otherwise prescribed by the law

Pursuant to Article 64 of the Civil Status Law 2014, the procedures for issuing copies of civil status extracts in Vietnam are as follows:

Step 1: Submit the request

Requesters for issue of civil status extract copies may directly or through representatives send declarations, made according to a set form, to the civil status database-managing agency.

In case a competent agency or organization requests an issue of a civil status extract copy of an individual in Vietnam, it shall send a written request clearly stating the reason to the civil status database-managing agency.

Step 2: Return the results

Immediately after receiving a request:

  • If seeing that the prescribed conditions are fully met, the civil status database-managing agency shall issue a civil status extract copy to the requester in Vietnam.
  • Failing to qualify, the management agency of the civil status database shall provide reasons.

In addition, Article 4 of the Civil Status Law 2014 stipulates that Civil status registration agency is the People's Committee of a commune, ward or township (below referred to as commune-level People's Committee), the People's Committee of a rural district, urban district, town or provincial city or an equivalent administrative unit (below referred to as district- level People's Committee) or an overseas Vietnamese diplomatic mission or consular office (below referred to as representative mission).

For Vietnamese people residing abroad, the issue of nationality is extremely important, especially for people with dual nationality. The following article helps you better understand the issue of multiple nationality and how to properly use a passport when entering and exiting between countries.

Multinationality policy in countries

The following typical countries accept multiple citizenship: Australia, UK, France, USA, Canada. You can apply for naturalization and hold 2, 3 or more nationalities as you wish. For example, a child born in the US to a Canadian father and an Australian mother may have both American, Canadian and Australian citizenship.

The following countries do not accept multiple nationalities: Russia, China, India, Japan, Korea, Singapore. Everyone applying for citizenship in the above countries must certify that they have renounced their current citizenship. In Japan and South Korea, children and teenagers under 21 years old can have multiple nationalities. But they will lose their Japanese or Korean citizenship if they do not renounce their other nationality when they turn 21.

In Germany, only children born to parents who are German citizens or permanent residents in Germany for three years or more can apply for German citizenship, regardless of whether they simultaneously apply for any other nationality. If an adult applies for German citizenship, they must renounce their current citizenship.

For Vietnam, multiple citizenship is accepted in the following cases:

  • Children born to parents with Vietnamese nationality.

  • Vietnamese expatriates currently living abroad who have lost or do not have Vietnamese citizenship wish to regain Vietnamese citizenship.

  • Vietnamese people living abroad apply for naturalization of the host country but do not apply to give up Vietnamese nationality.

Important notes when using two passports

One of the issues to note is how to use two or more passports correctly and conveniently when traveling between countries:

  • It is mandatory to use the passport of your current country of citizenship to enter and exit that country. For example: You have American and Vietnamese citizenship. When leaving the US, you must use an American passport. When entering Vietnam, you must use a Vietnamese passport and vice versa when returning. However, when checking in to airlines, you must present both passports to prove that you do not need a visa for the country you are flying to.

  • Never apply for a visa to enter the country of your citizenship. Citizens of a country never need a visa to enter or leave their country. For example, you may encounter a situation where a travel agency employee does not have the information and requires you to affix a visa to your US passport when buying a plane ticket to Vietnam while you have both nationalities.

Vietnamese passports are exempt from visas for some ASEAN countries

  • When you arrive in a third country, depending on the border management policy of that country, you can flexibly use your passport accordingly and economically. For example: You should use an Australian passport to enter Japan because it does not require a visa, while a Vietnamese passport requires a visa. Or you should use a Vietnamese passport to enter Indonesia because it is visa-free, while an Australian passport is not. Therefore, American, Australian, British, etc passports are not always more convenient or better. A Vietnamese passport is quite convenient when traveling between countries in ASEAN.

  • You should bring all your passports with you when traveling or working to any country. It helps you get help from all your ambassadors or consulates when required or in cases of force majeure.

For Vietnamese people living abroad, no matter what nationality they have acquired, they are still considered Vietnamese citizens by the Vietnamese Nationality Law until they are allowed to renounce their Vietnamese nationality or are stripped of their Vietnamese nationality. Therefore, when an overseas Vietnamese acquires another nationality, they have two nationalities at the same time.

Question 1. Which countries are allowed to have multiple nationalities?

Answer - The following typical countries allow multiple citizenship: Australia, UK, France, USA, Canada. You can apply for naturalization and hold 2, 3 or more nationalities as you wish.

Question 2. If I have more than 1 nationality, which passport should I use for entry and exit?

Answer - According to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014,

Foreigners with multiple passports may only use one passport to enter, exit, transit, and reside in Vietnam.

In general, when you leave/enter Vietnam, if you use a Vietnamese/foreign passport, you must use a Vietnamese/foreign passport when entering/exiting Vietnam.

Question 3. Will Vietnamese citizens who are granted a foreign nationality lose their Vietnamese nationality?

Answer - The Law on Vietnamese Nationality states that Vietnamese citizens can hold only one citizenship which is Vietnamese. However, in special cases, the Vietnam Government may allow dual citizenship. These are:

1. Vietnamese residing abroad but still keep their Vietnamese nationality before 1st July, 2009.

2. Cases in which citizens obtain Vietnamese citizenship without losing their other citizenships, according to Clause 3, Article 19 of the Law on Vietnamese Nationality, and Article 9 of Decree No. 16/2020/ND-CP dated February 03, 2020 on elaborating to Law on Vietnamese Nationality. 

3. Cases in which citizens are allowed to reclaim Vietnamese citizenship without losing their other citizenships, according to Clause 5, Article 23 of the Law on Vietnamese Nationality, and Article 14 of Decree No. 16/2020/ND-CP dated February 03, 2020 on elaborating to Law on Vietnamese Nationality.

4. Cases in which Vietnamese children are adopted by foreigners, according to article 37 of the Law on Vietnamese Nationality.

Question 4. In case a person has dual nationality, one nationality is Vietnamese, can he/she buy and have his/her name on the Certificates of land use rights?

Answer - Yes, people with dual citizenship can buy and have their names on the Certificates of land use rights like Vietnamese citizens without being limited to the same rights as foreigners. People with dual nationality, one nationality being Vietnamese, are still recognized as Vietnamese citizens with full rights and obligations to the State of Vietnam.
